Reading the rulings

Money and Property in a Polish Divorce

Money is usually where the fear sits: the home, the mortgage, the savings, and sometimes the quiet worry that assets are being moved out of reach.

Polish law starts from a fair place: what you built during the marriage is divided equally (art. 43 of the Family Code). The surprises are all in the detail. The family home is valued as though the mortgage did not exist. Being bought out does not take your name off the loan. And a spouse found solely at fault can be asked to support the other, though not forever.

These pieces work through published Polish rulings, so you can see how courts actually reason: what the law can undo when assets start quietly moving, and when maintenance to a former spouse is owed, and how it ends. Every article links to the original judgments, so you can read them yourself rather than take my word for it.

Property

The family home and the mortgage

Valued as though the mortgage did not exist: why a buy-out is half the full value, and why being bought out does not take your name off the loan.
