Children, Support and Parental Rights in a Polish Divorce

There is no child-support table in Poland, and no percentage formula. A court weighs what the child genuinely needs against what each parent can genuinely earn, and it treats the day-and-night work of raising a child as a real contribution (art. 135 of the Family Code).

Almost everything that surprises international parents follows from that one idea: absence shifts the burden toward money, and genuinely shared care lowers it; support does not simply stop at eighteen; and persistent non-payment can become a criminal matter, though courts separate the parent who cannot pay from the parent who will not.
